国务院关于出境入境管理的规定
Article 1: This regulation is formulated in accordance with the Exit and Entry Administration Law of the People's Republic of China and other laws, in order to standardize exit and entry administration, safeguard the lawful rights and interests of exit-entry travelers, and safeguard national sovereignty, security, and development interests.
第一条 为了规范出境入境管理,保障出境入境人员的合法权益,维护国家主权、安全、发展利益,根据《中华人民共和国出境入境管理法》等法律,制定本规定。
Article 2: The State shall establish and improve a system for preventing safety risks for Chinese citizens traveling abroad. The competent departments of the State Council for foreign affairs, culture, and tourism, as well as diplomatic missions abroad, shall promptly and publicly issue overseas safety alerts and travel-destination risk alerts based on the security situation in relevant countries and regions, including wars or armed conflicts, public security conditions, natural disasters, accidents, and infectious disease outbreaks. Chinese citizens shall pay attention to overseas safety alerts and travel-destination risk alerts, and avoid traveling to or remaining in high-risk countries or regions. When accepting and approving Chinese citizens' applications for exit-entry documents and conducting exit border inspections, immigration authorities shall, in accordance with notices from the relevant competent departments of the State Council, remind Chinese citizens planning to travel to high-risk countries or regions to exercise caution or closely monitor local security conditions, raise their vigilance, strengthen precautions, and pay attention to safety. In particular, for Chinese citizens planning to travel to countries or regions rated at the highest risk level, or where incidents seriously endangering personal safety occur frequently, authorities shall, when necessary, dissuade them from traveling there.
第二条 国家建立和完善中国公民出境安全风险防范制度。国务院外交、文化和旅游主管部门以及驻外外交机构应当根据有关国家和地区战争或者武装冲突、社会治安、自然灾害、事故灾难、传染病疫情等安全形势,及时公开发布国外安全提醒和旅游目的地安全风险提示。中国公民应当关注国外安全提醒和旅游目的地安全风险提示,避免前往及驻留高风险国家或者地区。移民管理机构在受理、审批中国公民出境入境证件申请和实施出境边防检查时,应当根据国务院有关主管部门的通知,提醒准备前往高风险国家或者地区的中国公民谨慎前往或者密切关注当地安全形势,提高警惕、加强防范、注意安全。其中,对准备前往风险等级为最高级别或者严重危及人身安全案件突发高发的国家或者地区的中国公民,必要时应当劝阻其前往。
Article 3: The reasons given by exit-entry travelers applying for exit, entry, stay, or residence shall be true and lawful. When verifying the identity of exit-entry travelers and the reasons for their applications, immigration authorities and visa authorities may inquire into relevant circumstances and require travelers to present or provide relevant documents, materials, electronic data, and other information; exit-entry travelers shall cooperate accordingly. Where a unit or individual issues a letter of invitation or other application materials for an exit-entry traveler, it shall be responsible for the authenticity of the invitation's contents and the matters attested to, and shall cooperate with immigration authorities and visa authorities in verifying the relevant information. Where an exit-entry traveler provides false materials or makes false statements, immigration authorities and visa authorities shall have the authority to decide not to issue exit-entry documents or not to permit the person to exit or enter the country.
第三条 出境入境人员申请出境入境、停留居留的事由应当真实、合法。移民管理机构、签证机关在核实出境入境人员的身份、申请事由时,可以询问相关情况,要求其出示、提供有关文件、资料、电子数据等信息,出境入境人员应当予以配合。单位或者个人为出境入境人员出具邀请函件或者其他申请材料的,应当对邀请内容和证明事项的真实性负责,并配合移民管理机构、签证机关核实有关信息。出境入境人员提供虚假材料、作出虚假陈述的,移民管理机构、签证机关有权决定不予签发出境入境证件或者不准其出境、入境。
Article 4: Where a Chinese citizen has been given an administrative detention penalty for fraudulently obtaining exit-entry documents or illegally exiting or entering the country, immigration authorities may, based on the circumstances of the violation and the need to prevent unlawful and criminal activity, decide to deny the person permission to leave the country for a period of six months to three years from the date the penalty is completed. Where a Chinese citizen engages in unlawful or criminal activities abroad that endanger national security and interests, the relevant competent department of the State Council, or, after verification by diplomatic missions abroad or other bodies, the provincial-level people's government of the person's place of domestic residence, may decide to deny the person permission to leave the country for a period of six months to three years from the date of their return to China. Where a Chinese citizen violates export control, technology import-export administration, or other regulations in ways that may endanger national industrial security or technological security, the relevant competent departments of the State Council, including the commerce department, may decide to deny the person permission to leave the country.
第四条 中国公民因骗取出境入境证件、非法出境入境受到行政拘留处罚的,移民管理机构可以根据违法情形和预防违法犯罪的需要,决定自处罚执行完毕之日起6个月至3年以内不准其出境。中国公民在境外从事违法犯罪活动,危害国家安全和利益的,可以由国务院有关主管部门,或者经驻外外交机构等核实后由其境内住所地省级人民政府决定自回国之日起6个月至3年以内不准其出境。中国公民违反出口管制、技术进出口管理等规定,可能危害国家产业安全、技术安全的,国务院商务等有关主管部门可以决定不准其出境。
Article 5: Where a foreigner provides false materials or makes false statements when applying for a Chinese visa abroad or applying for entry at a port of entry, immigration authorities and visa authorities may decide to deny the person entry for a period of one to five years. Where a foreigner has received a criminal penalty for obstructing national (border) administration, or an administrative penalty for fraudulently obtaining exit-entry documents or illegally exiting or entering the country, immigration authorities may, based on the circumstances of the violation and the need to prevent unlawful and criminal activity, decide to deny the person entry for a period of one to five years from the date the penalty is completed, except where otherwise provided by law. Where a foreigner is placed on a countermeasures list, an unreliable entity list, or a list of malicious entities, or is subject to countermeasures or restrictive measures, and it is necessary to lawfully adopt relevant measures such as not issuing exit-entry documents or denying entry, immigration authorities and visa authorities shall implement such measures in accordance with their respective duties.
第五条 外国人在境外申请办理中国签证或者在口岁申请入境时提供虚假材料、作出虚假陈述的,移民管理机构、签证机关可以决定1年至5年以内不准其入境。外国人因妒害国(边)境管理受到刑事处罚,或者因骗取出境入境证件、非法出境入境受到行政处罚的,移民管理机构可以根据违法情形和预防违法犯罪的需要,决定自处罚执行完毕之日起1年至5年以内不准其入境。法律另有规定的,从其规定。外国人被列入反制清单、不可靠实体清单、恶意实体清单或者被采取反制和限制措施等,需要依法采取不予签发出境入境证件或者不准入境等相关措施的,由移民管理机构、签证机关按照职责分工实施。
Article 6: For a person lawfully denied permission to leave the country, the deciding authority shall promptly notify immigration authorities to carry out the decision as provided, and shall notify the person in writing of the facts, reasons, basis, and avenues of redress for the denial of exit; where doing so could affect national security, the investigation of criminal cases, or similar matters, the person need not be notified. When immigration authorities carry out a decision to deny exit, they shall notify the person in accordance with the content of the notice from the deciding authority.
第六条 对依法决定不准出境的人员,决定机关应当按照规定及时通知移民管理机构执行,并向当事人书面告知不准出境的事实、理由、依据和救济途径;有可能影响国家安全、刑事案件侦查等情形的,可以不告知当事人。移民管理机构执行不准出境决定时,应当按照决定机关通知的内容告知当事人。
Article 7: The State shall implement filing-based management of agencies and individuals engaged in intermediary services, such as exit-entry policy consultation, document processing on behalf of clients, and handling of procedures, that are entrusted by exit-entry travelers. An agency engaged in exit-entry intermediary services shall file with the local immigration authority within 15 days of its establishment. An individual engaged in exit-entry intermediary services shall have filing procedures handled by the agency to which they belong. Those already engaged in exit-entry intermediary services before this regulation takes effect shall complete filing procedures within 90 days of the regulation's effective date. The specific measures for filing-based management of agencies and individuals engaged in exit-entry intermediary services shall be formulated by the national immigration administration department together with the market regulation department of the State Council and other competent departments.
